Blog / American Recovery-Reinvestment Act Brings Tax Credit to HVAC Industry

temp_file_294px-Official_seal_of_the_American_Recovery_and_Reinvestment_Act_of_2009.svg_.pngOn February 17, 2009, President Barack Obama signed into law “H.R. 1, the American Recovery and Reinvestment Act of 2009”.  This gave financial and health assistance to the unemployed, among other things. We have seen this law in effect for the past few months.                                                                

The Upside
Tax credits of up to $1500 are available for homeowners purchasing qualifying products that are “placed in service” between January 1, 2009 and December 31, 2010.  

The Downside
The truth, however, is that things are not always as clear as they seem.  

  • Not all homeowners may qualify for the credit.
  •  Still some questions as to which products truly qualify.

A good example of this is 14 SEER, 12 EER package gas electrics with only 80% efficient heating systems.  The cooling portion may qualify while heating portion may not.  ARI lists these units as “Eligible for Tax Credit”, while some manufacturers do not.  It will be up to the IRS to determine which of these products truly qualify.  Unfortunately, decisions from the IRS usually come at a glacial pace.  

Solutions
The prudent approach is to recommend that homeowners consult their tax consultants to see how the tax credit will apply to their situation specifically.  Provide them with the manufacturer’s documentation and/or documentation from ARI or, you may direct homeowners directly to the sites themselves.
